1. Acceptance of Terms

By creating an account on NurseFiti, you agree to these Terms of Service. NurseFiti is an NCK exam preparation platform for Kenyan nursing graduates.

2. Use of the Platform

NurseFiti is for personal, non-commercial use. You may not share your account, redistribute content, or use the platform to cheat in official NCK examinations.

3. Payments & Refunds

All payments are processed via M-Pesa. Subscription fees are non-refundable once the billing period has started. Session bookings may be cancelled up to 24 hours before the session for a full refund.

4. Tutor Earnings & Platform Fee

Tutors registered on NurseFiti earn income from 1-on-1 tutoring sessions booked by students on the platform. The following payment terms apply to all tutor accounts:

• Platform fee: NurseFiti deducts a 23% platform fee from each confirmed and paid session.
• Tutor net earnings: Tutors receive 77% of the gross session amount after the platform fee is applied.
• Payout schedule: Payouts are processed once per week, every Monday, via M-Pesa to the number registered on the tutor's profile.
• Minimum payout: The minimum payout threshold is KSh 1,000. Earnings below this amount carry over to the following Monday.
• Gross amount: The session gross amount is calculated as (duration in hours × hourly rate), rounded to the nearest KSh.
• Rate setting: Tutors set their own hourly rate. NurseFiti reserves the right to display this rate publicly on the platform.

NurseFiti reserves the right to adjust the platform fee percentage with 30 days' written notice to active tutors via their registered email address. The current applicable rate is always displayed in the tutor's Earnings dashboard and in the tutor onboarding guide.

5. Tutor Anonymity & Conflict of Interest

In accordance with the Constitution of Kenya and the Data Protection Act 2019 regarding the right to privacy, NurseFiti provides tutors the option to operate under a pseudonym. This feature allows tutors, including those employed by the Government of Kenya or other institutions, to share their expertise without conflict of interest or public exposure.

Students agree to respect this anonymity. NurseFiti assumes no liability for claims related to the true identity of anonymous tutors, provided they have been internally vetted by our team.

6. Educational Platform & Medical Advice Liability

NurseFiti provides educational content for learning and examination preparation purposes only.

NurseFiti is strictly an educational platform, not a clinical platform. Information, guidance, or instruction shared on this platform (including by tutors during live sessions) must not replace professional clinical judgment, institutional guidelines, NCK standards, MOH guidelines, or physician orders. NurseFiti shall not be held liable for any clinical actions taken based on content learned or discussed on the platform.

7. Academic Integrity Policy

NurseFiti is committed to promoting honest academic preparation for the NCK examinations. We strictly prohibit:

• Possession, distribution, or discussion of leaked official examinations.
• Stolen exam papers, insider information, or confidential exam materials.
• Impersonation, cheating assistance, or any form of examination malpractice.

We expressly allow and encourage:

• Syllabus-based predictions and revision.
• Mock exams and discussion of past publicly available papers.
• Exam techniques, strategies, and topic mastery.

Any user found violating the prohibited actions will be permanently banned from the platform.

8. Disclaimer, Sponsors & Limitation of Liability

While NurseFiti aims to provide high-quality revision resources, we do not guarantee that you will pass the NCK examination. NurseFiti is an independent educational tool and is not an "Official NCK partner", "NCK approved", or "NCK certified" unless expressly stated otherwise. Your use of the platform is at your own risk.

Sponsors and Partners Liability Protection: NurseFiti actively partners with sponsors—such as the Samburu Excellence Scholarship—to provide subsidized access to nursing students. By using the platform, you agree that NurseFiti, its founders, and all associated partners and sponsors are fully indemnified and bear no legal liability arising from interactions, transactions, content accuracy, or outcomes related to the platform. This provision is designed to protect the platform's intent—to serve as a smart, efficient revision tool while empowering students and tutors—from any undue legal exposure under Kenyan law.
